When Congress required the use of provisional balloting as part of the Help America Vote Act, its intention was to guarantee that no qualified voter be turned away from the polls. While provisional ballots may have done much to achieve this goal in the four years since HAVA was passed, significant issues in their administration have also arisen. Edward Foley of Election Law @ Moritz examines particular issues in Ohio during the 2006 election, while Wendy Weiser of the Brennan Center for Justice at the NYU School of Law takes a broader look at whether provisional ballots are working.
